摘 要
我国现行行政诉讼法没有规定行政诉讼简易程序，关于行政诉讼简易程序是否应当立法并付诸司法实践，理论界已进行了深入的探讨，其中主流观点支持构建行政诉讼简易程序。在实践领域，最高人民法院已开始在部分地区的基层法院开展行政诉讼简易程序的试点工作，并取得了较好的社会效果和法律效果。行政诉讼简易程序是追求司法效率和司法公正的需要，也是解决我国现有行政诉讼实践中存在问题的一种方法，因此行政诉讼简易程序的构建势在必行，符合社会主义法治建设的发展潮流。
本文主要阐述了行政诉讼简易程序的概念、特点，该制度的理论基础、价值目标和域外行政诉讼简易程序的立法司法概况，以及构建行政诉讼简易程序的必要性和可行性。从这几个方面说明了建立行政诉讼简易程序制度的现实迫切性。同时对行政诉讼简易程序的具体制度构建和实践操作程序进行了初步的探讨，认为可以从适用标准的确定、审判组织的确立以及具体程序的设计等方面来具体构建我国的行政诉讼简易程序，以此为司法实践提供初步的理论指导。

Abstract
China's current administrative procedure law of administrative litigation no provisions on administrative litigation simple procedure, summary procedure shall be put into legislation and whether the judicial practice, theorists have thoroughly discussed, including the mainstream view of administrative litigation support construction simple procedure. In the practice field, the supreme people's court has started in some areas in the administrative litigation grass-roots court simple procedure pilot job, and achieved good social effect and legal effect. Administrative litigation simple procedure is pursuing judicial justice and efficiency, but also the need to resolve our country's existing administrative litigation practice of the existing problems in a kind of method, so the construction of the administrative litigation summary procedure is imperative, accord with the development of socialist legal construction trend.
This paper mainly expounds the concept of administrative litigation summary procedure of the system and characteristics, the theoretical basis, value goal and exile of administrative litigation legislation general summary procedure and the construction of the judicial administrative litigation, the necessity and feasibility of the summary procedure. From these aspects that the establishment administrative litigation summary procedure system of practical significance. Meanwhile the simple procedure of administrative litigation specific system construction and practice operating procedures carried on the preliminary discussion to think can from the standard applicable to determine the establishment of judging, organization and specific program design aspects of concrete building our simple procedure of administrative litigation, which provide for judicial practice preliminary theoretical guidance.
