Termination Policy 终止政策

Preamble 前言

This policy was established to provide guidelines regarding termination of employment from the University.

此政策旨在为终止雇佣提供指导方针。

An employment contract may be terminated immediately upon expiration of the contract term.

雇佣合同在劳动合同到期后随即终止。

Generally, the termination is one of voluntary termination, involuntary termination and consulted termination.

一般来说,终止劳动合同包括自愿,非自愿及协商终止。 Applies to 适用范围

Full time staff of the University. 大学全体教职员工 Regulations 规定

1. Voluntary Termination 自愿终止

Voluntary termination is a voluntary decision made by an employee to resign the employment of the University. 自愿终止指员工主动决定离职。 2. Involuntary Termination 非自愿终止

Involuntary termination is a decision by the University to terminate the employment of an employee.

非自愿终止指学校决定终止雇佣。

An employment contract may be terminated immediately according to national law and this regulation, if employee:

如发生以下情况,学校依据国家法律和本政策立即终止雇佣合同:

1) Is proved during the probation period not to satisfy the conditions for employment;

试用期表现证明其不符合要求; 2) Materially breaches the University‘s rules and regulations, further information can be

referred to Disciplinary Procedure; 出现违反学校规章制度的行为,更多相关规定见―违纪处理程序‖。 3) Commits serious dereliction of duty or practices graft, causing substantial damage to

the XJTLU;

严重渎职或收受贿赂,并给学校带来严重损害。

4) Has additionally established an employment relationship with another employer

which materially affects the completion of his tasks with the University, or he refuses to rectify the matter after the same is brought to his attention by the employer;

已建立了与学校之外的其它雇用关系,严重影响了学校交办任务的完成,或在引起雇

用单位注意后仍然拒绝对此行为进行纠正。 5) Has his criminal liability pursued in accordance with the law.

被依法追究刑事责任者。

University may terminate an employment contract by giving the employee himself 30 days‘ prior written notice, or one month‘s salary in lieu of notice, if:

在以下情况下,学校可提前30天发出书面通知或在不事先通知而是支付一个月薪资的情况下终止雇用合同:

1) After the set period of medical care for an illness or non-work-related injury, the

employee can engage neither in his original work nor in other work arranged for him by University;

疾病或非工伤治疗期限后,员工不但无法完成其本职工作也无法胜任学校交办的其他任务; 2) The employee is incompetent and remains incompetent after training or adjustment

of his position;

员工无法胜任本职工作,在经历岗位培训和调整后仍然未有改观; 3) A major change in the objective circumstances relied upon at the time of conclusion

of the employment contract renders it unperformable and, after consultations, the University and employee are unable to reach agreement on amending the employment contract.

在合同签订时,客观情况发生了重大变化造成合同无法执行,在学校和员工进行协商后,双方仍无法就变更雇佣合同达成一致。 The University endeavors to provide stable employment for the staff. However, situations such as a lack of funds, lack of work, or reorganization may require a reduction in the work force. If that happens in your unit, and you will be laid off, you will receive written notice no less than thirty calendar days prior to layoff.

学校努力为其员工提供一个稳定的环境。但是,如果学校发生了资金缺乏,业务量缺少或结构重组的情况,学校可能进行人员的精简。裁减员工前应提前至少30天书面通知员工。 3. Consulted Termination 协商终止

Consulted termination is that both the University and the employee may terminate their employment contract if they go agree after consultations. 协商终止指学校和员工在协商后双方就终止合同达成了一致。

Economic compensation is paid if it is occurred in accordance with relevant State regulations.

如果协商终止符合国家法律规定,应给予员工经济赔偿。

Procedures 程序

Voluntary Termination 自愿终止

1) An employee is expected to give as much advance notice to both University HR and

Supervisor as possible but no less than 30 days (Academic and ELC staff follows the notice agreed in the employment contract). During the employee‘s probation period,

an employee may terminate his employment contract by giving University HR and Supervisor three days‘ prior notice.

员工辞职应提前至少30日以书面形式通知向人力资源部门和上级主管领导(教学和英语语言中心成员依据劳动合同中的具体规定执行)。员工在试用期内辞职则应提前三天通知人力资源部门和上级主管领导。

2) The employee must work the entire notice period unless the time off was requested

and approved by head of division and human resources office prior to the resignation.

除非经主管部门和人力资源部批准的情况下,员工必须在整个通知期限内继续履行其工作职责。 3) The Leaving Process Form should be completed before the last working day to

ensure all the documents, facilities and cash etc have been returned back to the related departments.

员工应在离职前完整填写―离职程序表‖以确保所有文件,用品和现款等的归还。 Involuntary Termination 非自愿终止

1) The Supervisor must review an involuntary termination decision with head of the

division, the related SMT member, and the Human Resources prior to the issuance of a decision.

在对员工的非自愿终止做出正式决定之前,上级主管领导必须会同部门领导、相关高层管理团队成员和人力资源进行决定前的审议。 2) Involuntary Termination Notice must be completed to outline the termination reasons, the notice term, etc.(refer to Appendix)

非自愿终止通知必须说明终止原因和通知期限(参见附件)。 3) The employee must work until the last working day of the notice term, unless

otherwise decided by the University.

员工必须工作至通知期限规定的最后一个工作日,除非学校另有决定。 4) The Leaving Process Form should be completed before the last working day to

ensure all the documents, facilities and cash etc have been returned back to the related departments.

员工应在最后一个工作日之前完整填写―离职程序表‖并确保已归还所有文件、用品和现款等。 Consulted Termination 协商终止

1) The consulted termination should be negotiated by employee and University before

any decision is made. The employee, the head of the division, the related SMT member and a representative from HR Office should attend the meeting, together to decide all the related issues.

在做出任何有关协商终止的决定前,学校应和员工进行必要的协商。协商会议由员工本人,部门负责人,高层管理团队相关成员及人力资源代表共同参加,以就相关事宜做出决定。 2) The employee must work until the last date of notice term, unless otherwise agreed

by the parties.

员工必须工作至通知期限规定的最后一天,除非双方另有约定。

3) The Leaving Process Form should be completed before the last working day to

ensure all the documents, facilities and cash etc have been returned back to the related departments.

员工应在最后一个工作日之前填写―离职程序表‖并确保已归还所有文件、用品和现款等。 Should this Policy for Termination be in conflict with the PRC laws and regulations, the PRC laws and regulations shall prevail.

如果此合同终止制度与中华人民共和国法律法规出现相抵之处,则以国家法律法规为准。
