Harassment Policy 骚扰政策

Xi‘an Jiaotong-Liverpool University is committed to creating a working and learning environment which is free from harassment and unlawful discrimination. It is committed to creating a culture which protects the dignity of all staff, irrespective of their sex, racial or ethnic background, sexual orientation, disabled status or age.

西交利物浦大学承诺营造一个无骚扰,无非法歧视的工作和学习环境,承诺在学校的文化建设下,所有员工,不论性别,种族,民族,性取向,残疾及年龄都能受到人格尊严的保护。 Harassment can be intimidating, offensive and prejudicial to a productive working environment. It is indicative of a lack of respect for the person harassed, undermines the person‘s position and may have an impact upon all aspects of an individual's life.

骚扰会对良好的工作环境造成威胁和损害,是对被骚扰者不尊重的表现,损害其名誉,并对其生活的各个方面都会产生不利影响。

The University is committed to a policy of equality of opportunity and regards all forms of harassment and bullying as most serious matters. Breaches of this policy will be sensitively but appropriately handled and in most circumstances it is hoped that incidences of harassment may be dealt with informally. There may at times be grounds for disciplinary action to be taken which may include dismissal from the University.

The University will take steps to ensure that those individuals with responsibility for dealing with matters raised under the provisions of this policy will have received appropriate guidance and training and the University will explore the most appropriate ways of providing support to individuals coping with such difficult situations.

1.1 Harassment is unacceptable behaviour, which can range from violence and

bullying to more subtle behaviour such as ignoring an individual at work or study. It subjects an individual or a group to unwelcome attention, intimidation, humiliation, ridicule, offence or loss or privacy. It is unwanted by the recipient and continues after an objection is made, although a single incident may be serious enough to constitute harassment and justify a complaint.

骚扰是一种不可接受的行为,包括暴力,欺凌及在工作或学习时忽略他人等一些细节行为,这些行为使某个人或某个群体在非自愿的情况下受到不良关注,胁迫,嘲笑,触犯或损失及隐私的侵犯,且在受害者拒绝之后仍然继续实施此行为。严重单个此类事件亦可构成骚扰并可予以投诉。

1.2 This definition includes sexual and racial harassment, and bullying as well as

any other form of personal harassment arising from disability, sexual orientation, age or religion. It can be a single explicit incident causing distress or repeated unacceptable behaviour affecting the dignity of any individual which appears or feels offensive, demeaning, intimidating or hostile.

1.3 Set out below are examples of harassment which will act as a guide to those

charged with dealing with such matters. They should not be taken as an exhaustive or exclusive list.

Personal Harassment 人身骚扰

2.1 Personal harassment can be defined as any treatment or behaviour which has

the effect of creating a hostile or intimidating environment for an individual or group of individuals and which has the effect of causing physical or emotional harm to the person or persons who are subject to such treatment.

人身骚扰是指对个人或群体构成敌对或威胁,或对其造成身体或心理损伤的行为。

2.2 Bullying is a particular form of personal harassment. It is threatening, abusing,

intimidating or insulting behaviour that may be an abuse of power. Bullying makes the recipient feel threatened, humiliated or patronised and creates an intimidating environment. (It can result in under performance, absenteeism, stress-related illness, resignation and can damage or block career prospects). 欺凌是人身骚扰的一种具体形式,即威胁、伤害、恐吓或侮辱的行为,往往发生于滥用职权的情况。受害人往往感到遭受到威胁、侮辱或鄙视或身处此种环境中(造成工作效率底下、旷工、疾病、辞职或对其职业发展造成损害或阻碍)。

2.3 In the University context, bullying can include:

? Academic bullying, defined as ?asserting a position of intellectual superiority

in an aggressive, abusive or offensive manner, threats of academic failure, public sarcasm.

? Abuse of power by a superior in such matters as, for example, appraisal,

promotion and discretionary pay.
