has been exercised in a contractor's appointment or retention by Agent. Owner agrees to pay the Agent $75 per hour with a minimum of 1 hour, billed in hour increments to purchase materials, observe workmen, obtain building permits and estimates, to meet with building inspectors, appraisers, insurance adjusters, contractors, utility service men (water, gas, electricity, telephone) and any other requirement of the owner not normally connected with the day to day management and operation of the Property.
To purchase on behalf of the Owner all equipment, supplies, and materials necessary for the maintenance and operation of the Property;
To refer matters requiring legal services to qualified professionals. (These services may include eviction proceedings and suits for recovery of lost rents and damages above the amount of the security deposits.)
To exercise a landlord's lien for non-payment of rents and Owners shall indemnify and hold harmless the Agent except in cases of willful misconduct or gross negligence.
16. Landscape Maintenance - During periods of vacancy, Owner specifically authorizes Agent to perform all reasonable landscape maintenance and understands that all such charges will be paid from the operating account.
During periods of occupancy, if it is determined by Agent that the grounds are being neglected or abused by the resident, Owner specifically authorizes Agent to perform landscape maintenance and understands that all such charges will be paid from the operating account. Said charges will be billed to the resident, if said charges remain unpaid for a period of sixty (60) days after billing, Owner authorizes Agent to apply all rents subsequently collected first to such charges, then to rent due, and, on this basis, Agent may initiate eviction proceedings for non-payment of rent.
17. Hold Harmless - The Agent shall account for all collections and expenditures made hereunder and it is agreed that the Agent shall not be liable except for collections actually received. The Owner agrees to indemnify, defend, and save harmless the Agent from and against expense (including court costs and attorney's fees), loss, damage,
fines, penalties, claim, demand, cause(s) of action, or liabilities arising from and acts of the Owner, Agent, or resident. The Agent is also held harmless from any other claim, demand, cause(s) of action, or legal proceeding which may be brought against the Agent by reason of his connection with the renting and management of the premises, except in cases of willing misconduct or gross negligence on part of Agent.
18. Consideration - In consideration for the services to be rendered to the Owner by the Agent under this Agreement, the Owner agrees to pay the Agent:
For Management, ____________, of the gross rent collected or a minimum fee of $25.00 per month, (10%, 8%, $60, $50 or $35)
For residential leasing or re-letting 50-100 % of one month's rent. Refund policy is as follows: If tenant vacates for any reason between 0-30 days, a full refund of the leasing commission is given to Owner; 30-60 days - 2/3 refund; 61-90 days - 1/3 refund; over 90 days -zero.
Owner will reimburse manager for ads specifically placed for this property. Ad expense not to exceed $150 in any month without the owner's approval.
For re-leasing a property to an existing tenant or writing a new lease for a tenant, $150.00, ( included in 10% & 8% management)
One half of all late charges and all of returned check charges will be retained by Agent.
For delivering or mailing a \Day Notice to Vacate\letter or other letter or notice to a tenant, $25; for filing an eviction case, $75; for attending an eviction hearing, $125; for recording and reporting judgments, lease violations at the court house and with credit reporting entities, $50 for each separate reporting.(included in 10% & 8% management)
All long distance phone charges incurred on behalf of the owner will be reimbursed to Agent.
All copying costs incurred on behalf of the owner will be paid from the property account at a cost of 10 cents per copy.
In no event shall the Agent's compensation be less then $25.00 per month.
19. SPECIAL PROVISION -
Owner shall approve all leases and tenants.
Owner shall purchase a programmable lock box for each unit of a property at a cost not to exceed $50 dollars perlock box.
Owner shall provide a complete sets of keys for current tenants and complete set of rekeyed keys for unoccupied properties. Additional copies up to 4 copies for tenants and for the property file shall be made and charged to the owner.
20. Entire Agreement - This Agreement constitutes the entire agreement between the Owner and the Agent with respect to the leasing management and operation of the Property, and no change will be valid unless made by supplemental written agreement approved executed or acknowledged in writing by both parties.
